Kustomcode and its affiliates design software tools, telemetry pipelines, and diagnostic interfaces. We do NOT provide licensed financial advice, asset management, or vehicle modification warranties. All users, quants, developers, and technicians operate our software strictly at their own independent risk and discretion.
1. Quantitative Telemetry & Non-Advisory Trading Disclaimer
1.1 Financial Services Disclaimer (FAIS Act Notice): Signals, market regime indicators, VWAP/EMA calculations, Z-Bot telemetry, and backtesting notebooks distributed through kustomcode.xyz or related Telegram feeds do NOT constitute financial advice, investment counsel, or discretionary asset management under the Financial Advisory and Intermediary Services Act (FAIS Act 37 of 2002) of South Africa or foreign equivalent financial regulatory bodies.
1.2 Substantial Risk of Capital Loss: Trading foreign exchange, equities, cryptocurrencies, indices, and derivatives carries significant financial risk. Market prices are inherently volatile, and you may lose some or all of your invested capital. You must never trade with money you cannot afford to lose.
1.3 Past Performance & Model Limitations: Historical backtest metrics, Sharpe ratios, win rates, and simulated expected value calculations ($EV_net) reflect mathematical modeling and past market conditions. Past performance is never a guarantee or reliable predictor of future trading results.
2. Automotive Diagnostics & ECU Calibration Disclaimer
2.1 Diagnostic Data Accuracy: Diagnostic trouble codes (DTCs), live sensor parameter readings, freeze-frame captures, and actuator test outputs supplied by KustomDiagnostics Pro are provided for workshop diagnostic assistance. Sensor accuracy relies directly upon connected OBD-II hardware, vehicle wiring integrity, and OEM protocol implementations.
2.2 ECU Flashing & Calibration Risk: Flashing vehicle Electronic Control Units (ECUs/TCUs) involves low-level microcontroller memory modifications. The user warrants that all operations are conducted with a stable external power supply (>12.2V DC) and verified checksums. Kustomcode disclaims all liability for bricked control modules, engine damage, or component failure arising from improper calibration, battery drop, or incorrect bin file selection.
2.3 Emissions & Roadworthiness Compliance: Custom ECU calibrations and performance modifications are designed exclusively for sanctioned motorsport, dyno evaluation, or off-road use. The vehicle owner is solely responsible for compliance with national emissions regulations, road traffic acts, and OEM manufacturer warranty conditions.
3. General Software Warranty & Liability Limitations
3.1 “AS IS” Provision: All software, developer APIs, webhook relay gateways, parcel tracking plugins, and publications are provided on an “AS IS” and “AS AVAILABLE” basis without express or implied warranties of merchantability or fitness for a particular purpose.
3.2 Consequential Damages Exclusion: In no event shall Zash Holdings Pty Ltd t/a Kustomcode, its directors, engineers, or partners be liable for any direct, indirect, incidental, special, exemplary, or consequential damages (including loss of profits, loss of data, business interruption, vehicle downtime, or trading losses) arising out of the use of or inability to use our systems.
3.3 Maximum Aggregate Liability: To the maximum extent permitted by applicable South African law, our aggregate liability for all claims related to any paid software service shall not exceed the total subscription or license amount paid by the customer during the preceding three (3) calendar months.
