Terms of Service & Master Agreement
Binding legal agreement governing user access, developer APIs, quantitative telemetry, automotive diagnostics, digital publications, and client portals across all Kustomcode properties.
Master Terms Sections
1. Age Gate & Warranties
Access to and registration on any Kustomcode platform is strictly restricted to individuals who are at least 18 years of age (or the age of legal majority in your local jurisdiction) with full legal capacity to enter into binding contracts.
By purchasing licenses or utilizing Kustomcode APIs, you explicitly warrant that:
- All registration, billing, and organizational details provided are accurate and authentic.
- You will not use developer APIs or reverse proxy gateways for illegal interception, DDoS attacks, or prohibited market manipulation.
- Falsification of identity or breach of safety governors results in immediate license revocation without refund.
2. Developer API Quotas & Software Licenses
The $9.99/mo (R180/mo) Developer Market & Signals API, SDKs, and Relay Ingress Gateways grant subscribers a non-exclusive, non-transferable, revocable commercial license subject to rate limit quotas and terms of service.
- •Rate Limiting & Bursting: Standard developer keys are subject to tier rate limits (e.g. 60 requests/minute). Abuse or attempts to bypass rate limiting will result in automated throttling or API key revocation.
- •No Raw Feed Redistribution: You may build internal algorithms, web applications, or trading bots. You may not re-license, redistribute raw tick-by-tick feeds, or resell the raw developer API to third parties without prior written enterprise approval.
3. AI Output & Algorithmic Trading Non-Advisory Disclaimer
Z-Bot quant feeds, indicator endpoints, and corporate AI concierge models provide analytical computations on an “AS IS” basis.
All algorithmic indicators, regime classifications, and signals do not constitute financial advice under South Africa's FAIS Act (Act 37 of 2002). Kustomcode explicitly disclaims liability for financial trading losses or capital drawdowns resulting from automated bot executions.
4. Payments, PayFast Gateway & Refund Policy
Payments for subscriptions, developer tokens, and publications are processed in USD or ZAR via our authorized PayFast payment gateway or Stripe.
Digital Delivery Waiver: Digital publications (PDFs), immediate API key provisions, and instant software activations are delivered upon transaction approval. Under Section 44(2) of ECTA, statutory 7-day cooling-off periods do not apply once digital goods have been accessed or downloaded.
5. Enterprise B2B Whitelist Access Controls
Access to enterprise SaaS management portals (including fleet.kustomcode.xyz and zbot.kustomcode.xyz) is restricted to whitelisted organization tenants holding active enterprise licenses. Kustomcode reserves the right to suspend API key access or terminate tenant instances in the event of unpaid license fees or SLA breaches.
6. Governing Law & Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to any principles of conflicts of law.
Any dispute, controversy, or claim arising out of or relating to this agreement shall be submitted to confidential arbitration in Gauteng, South Africa, administered by the Arbitration Foundation of Southern Africa (AFSA), or escalated to the High Court of South Africa (Gauteng Division).
