Z-BOT QUANTITATIVE TELEMETRY TERMS & RISK DISCLOSURE

1. NON-FINANCIAL ADVISORY STATUS (FSCA & SEC COMPLIANCE)
Z-Bot and KustomCode Enterprise (Pty) Ltd operate strictly as a SaaS software provider and quantitative telemetry analytics developer. Z-Bot is not a financial services provider, registered investment advisor (RIA), broker-dealer, asset manager, or fiduciary under the Financial Advisory and Intermediary Services (FAIS) Act of South Africa or SEC regulations.
All quantitative metrics, technical signals, expected value calculations ($EV_net$), and backtesting outputs generated by Z-Bot constitute raw algorithmic telemetry and automated execution logic. Nothing on this website or terminal constitutes investment, financial, tax, or legal advice.
2. ASSUMPTION OF ALL FINANCIAL RISKS & NO GUARANTEES
Trading stocks, futures, options, forex, and cryptocurrency involves significant risk of monetary loss. Past backtesting results or paper trading execution metrics do not guarantee future live trading performance. Slippage, liquidity gaps, latency, market anomalies, and broker execution delays can impact live trade returns.
By utilizing Z-Bot, you acknowledge and agree that you assume 100% of all financial risks, trading drawdowns, capital losses, and execution outcomes. Neither KustomCode Enterprise nor its officers accept any liability for financial losses incurred through automated or manual trade execution.
3. ECTA SECTION 44 DIGITAL GOODS REFUND WAIVER
Pursuant to Section 44(2) of the Electronic Communications and Transactions Act (ECTA Act 25 of 2002), Z-Bot software subscriptions, API license keys, and Quantitative Telemetry Feeds constitute un-returnable digital software services and real-time data access.
MANDATORY CONSENT: Upon payment, account activation, or API key generation, you explicitly consent to the immediate provision of digital services and acknowledge that you forfeit all rights to a statutory cooling-off refund under ECTA Section 44. All SaaS subscription fees and signal purchases are strictly non-refundable.
4. POPIA PRIVACY & ENCRYPTED KEY ISOLATION
In compliance with the Protection of Personal Information Act (POPIA Act 4 of 2013), all user credentials, broker API keys (Alpaca, ByBit, OANDA), and license keys are encrypted at rest using AES-256 standards. Your private broker keys are isolated within dedicated NestJS database partitions and are never stored in plain text or shared with third parties.
